After the disbanding of the Tennessee Human Rights Commission (“THRC”), there was significant concern that Tennessee would no longer have a worksharing agreement with the U.S. Equal Employment Opportunity Commission (“EEOC”). When the EEOC and a state fair employment practices agency have a worksharing agreement, the deadline for a worker in that state to file with the EEOC is 300 days of a discriminatory or retaliatory act. However, when there is no worksharing agreement, a worker must file with the EEOC within 180 days or lose their right to pursue their claim.
Fortunately, just days before the final dissolution of the THRC occurred on July 1, 2025, the EEOC negotiated a worksharing agreement with Tennessee’s Office of the Attorney General. That means that Tennessee workers will still have 300 days to file their charges with the EEOC. This is a significant victory for Tennessee workers that gives employees about four additional months to preserve their claims.
