What Does USERRA Cover?
- Non-Discrimination: Employers cannot discriminate against you based on your military service. This protection extends to hiring, promotions, and benefits.
- Right to Reemployment: Once your military service concludes, you have the right to resume your civilian job as if you had never been absent. Your seniority, pay, and benefits should be the same as if you had been continuously employed.
- Health Insurance: You can opt to continue your existing employer-based health insurance for up to 24 months while serving. Upon your return, you have the right to immediate reinstatement of your health insurance, with no waiting periods.
- Protection from Discharge: After reemployment, you can’t be discharged without cause for a certain duration, contingent on the length of your military service.
Your Responsibilities
USERRA also sets forth certain responsibilities for service members:
- Notification: Inform your employer of your military service unless it’s impossible or unreasonable due to military necessity.
- Duration: Your cumulative time away from your job for military service should not exceed five years, with specific exceptions.
- Timely Return: After completing your service, you must return or apply for reemployment within a period determined by the length of your military service.
